Terms of Service

These Terms of Service (the "Terms") govern your use of the Elynd service (the "Service", "we").

The Service is operated by the Elynd Service Administration, operating in the Republic of Kazakhstan.

How we process your data is described in a separate Privacy Policy.

By using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree with these Terms, do not use the Service.

Elynd is a tool for planning and preparing LinkedIn posts using artificial intelligence. The Service helps you build a strategy, content plans and post drafts, and publish them to LinkedIn at your command.

The Service is in beta. This means its functionality may change, contain errors, become temporarily unavailable or be discontinued. The Service is provided "as is" and "as available" to the extent permitted by applicable law.

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us of any unauthorized access. You agree to provide accurate information when signing up.

You retain all rights to the content you create in or upload to the Service: your strategy, topics, drafts, writing samples, images, materials and published posts.

To make the Service work, you grant us a limited license to process this content solely to provide the Service to you: to generate, store, display and publish it at your command. We do not use your content for any other purpose and do not share it with third parties other than the subprocessors listed in the Privacy Policy.

You are responsible for ensuring that your content does not violate any law or the rights of third parties, and that you have the right to use the writing samples, images and other materials you upload.

The Service creates texts, plans and topics using artificial intelligence models. Please note:

• Generated content may contain inaccuracies, errors or statements that are not true. AI does not guarantee the factual accuracy, appropriateness or quality of the output.
• You must review and edit any generated text yourself before publishing it. The decision to publish a post is yours.
• You bear full responsibility for the content you publish under your name, including content originally generated by the Service.
• We are not responsible for the consequences of publishing generated content, including reputational, professional or other consequences.

• The Service publishes posts to LinkedIn on your behalf and at your command, using the authorization you have granted.
• Your use of LinkedIn is governed by LinkedIn's own terms. Elynd is not affiliated with LinkedIn and does not control its operation.
• Once published, a post can no longer be changed by the Service. You cannot edit or withdraw a published post through Elynd - this must be done directly on LinkedIn.
• We are not responsible for actions, restrictions or changes by LinkedIn or other third-party services, including any suspension of access.

You agree not to use the Service to:

• create or publish unlawful, misleading or fraudulent content, spam, hate speech, or content that violates the rights of third parties;
• attempt to disrupt the Service, circumvent its limits or gain unauthorized access;
• use the Service in an automated way beyond what its interface provides;
• do anything that violates LinkedIn's terms.

We may suspend or terminate your access if you violate these rules.

During the beta, the Service is provided free of charge. We may introduce paid subscription plans in the future; registered users will be notified of such changes in advance, and they will not apply retroactively to free services already provided.

The Service is provided "as is" and "as available", without any warranties - express or implied - as to its operation, availability, accuracy or fitness for a particular purpose.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental or consequential damages arising out of or in connection with the use of, or inability to use, the Service, including loss of data, lost profits or reputational harm.

The extent of this limitation of liability depends on applicable law; in some jurisdictions, some of these exclusions may not apply to consumers.

The Service itself - its code, interface, design, texts, generation logic and other elements of the product - belongs to us and is protected by intellectual property law. These Terms do not transfer to you any rights to the Service other than the right to use it in accordance with these Terms.

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms or if the Service is discontinued. After your account is deleted, your data is handled in accordance with the Privacy Policy.

We may update these Terms as the Service evolves. We will notify registered users of material changes. Continued use of the Service after the changes means you accept them.

These Terms are governed by the laws of the Republic of Kazakhstan. Disputes are resolved in accordance with the laws of that jurisdiction.
